Mr RI introduced the Constitution of the Republic of Korea (Article 6(2)), which states that the status of foreigners is guaranteed in compliance with international laws and treaties as well as The National Human Rights Commission Act (Article 4). The latter provides the scope of its application to nationals of the Republic of Korea and foreigners in its territory. These provisions stipulate that the government is obliged to protect foreigners residing in the country and also guarantee their rights. The Korean government has improved its legal and institutional systems in order to integrate migrants. However, Mr RI added that migrant workers, particularly the undocumented ones and their family members, are still facing limitations on their basic rights. They are excluded from the multicultural policy of Korean government.

Mr RI then introduced the National Human Rights Commission of Korea (NHRCK), which has been conducting programmes and interventions that cater to the needs of special categories of migrants which include irregular migrant workers, families of migrant workers, migrant women, and refugees. Special thematic foci include the right to health and to education, especially for the children of migrants. Mr RI added that the NHRCK needs to refine its advocacy role to strengthen legislative and institutional groundwork. It should play a coordinating role in assisting the Korean government in the development of national legislation that is in accordance with international human rights standards.
